Please read these Terms and Conditions carefully before using the Dryganic website or purchasing any of our products. These terms govern your access to and use of our services and constitute a legally binding agreement between you and Blue Moon Enterprise.
1. Acceptance of Terms
By accessing or using the Dryganic website, placing an order, or using any of our services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with any part of these terms, please do not use our website or services. These Terms constitute a legally binding agreement between you and Blue Moon Enterprise (operating as Dryganic).
2. Company Information
Dryganic is a brand operated by Blue Moon Enterprise, registered in India. Our registered address is: Blue Moon Enterprise, Azamgarh, Uttar Pradesh – 276131, India. Our products are manufactured and sold in compliance with applicable Indian food safety regulations, including those prescribed by the Food Safety and Standards Authority of India (FSSAI).
3. Products and Pricing
All product descriptions, images, and prices on our website are subject to change without prior notice. Prices are displayed in Indian Rupees (INR) and are exclusive of GST (Goods and Services Tax). A 5% GST is applicable on all products (HSN code 0813 — dehydrated fruits) and is added at the time of checkout. The GST amount is shown as a separate line item in the order summary before you confirm your purchase, and is reflected on your invoice. We reserve the right to modify or discontinue any product at any time and to refuse or cancel any order placed at an incorrect or erroneous price. Product images are for representational purposes; actual product colour or texture may slightly vary.
4. Orders and Payment
When you place an order, you confirm that all information provided is accurate, current, and complete. We accept the following payment methods: UPI (Google Pay, PhonePe, Paytm, etc.), Debit/Credit Cards, Net Banking, and Cash on Delivery (COD) — all processed securely through Razorpay or our COD partner. Payment for online orders must be completed in full at checkout before your order is processed. For COD orders, full payment must be made to the delivery agent at the time of delivery. We reserve the right to cancel COD orders from locations or customers with a history of non-payment.
5. Order Cancellation
You may cancel your order within 24 hours of placing it, provided the order has not yet been dispatched. To request a cancellation, contact us immediately at dryganicproducts@gmail.com with your order number. Cancellations after 24 hours or after dispatch are not accepted. For successfully cancelled online orders, the refund will be credited to your original payment method within 5–7 business days.
6. No Return Policy
All sales are final. We do not accept returns on delivered products. Our products are consumable food items and, for hygiene, food safety, and quality assurance reasons, cannot be returned once delivered. We encourage customers to read product descriptions, ingredient lists, and allergen information carefully before purchasing. By placing an order, you acknowledge and accept this no-return policy.
7. Damaged, Defective, or Incorrect Items
If you receive a product that is damaged, defective, or different from what was ordered, please contact us within 48 hours of delivery at dryganicproducts@gmail.com with your order number and clear photographs of the item and packaging. We will, at our discretion, dispatch a replacement or issue a full refund. This is in accordance with the Consumer Protection Act, 2019. We do not offer replacements or refunds for complaints raised after 48 hours of delivery.
8. Shipping and Delivery
We process and dispatch orders on business days (Monday to Saturday, excluding public holidays). Estimated delivery timelines vary by location — please refer to our Shipping Policy for details. We are not responsible for delivery delays caused by our logistics partners, natural events, strikes, or circumstances beyond our reasonable control. Risk of loss and title for products passes to you upon delivery.
9. Intellectual Property
All content on this website, including text, graphics, logos, images, product photographs, and software, is the property of Blue Moon Enterprise and is protected under applicable Indian intellectual property laws including the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our express written permission.
10. Limitation of Liability
To the fullest extent permitted under applicable Indian law, Blue Moon Enterprise shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services, including loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid for the specific product giving rise to the claim.
11. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through amicable discussion. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts located in Azamgarh, Uttar Pradesh, India. Nothing in this clause limits your rights as a consumer under the Consumer Protection Act, 2019.
12. Changes to Terms
We reserve the right to update these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
